Allman Brothers and Cheap Trick Lawsuit | ||||||||||||

| (EZ-Tracks) - The Allman Brothers (known for “Ramblin’ Man”) and Cheap Trick (known for “Dream Police”) have recently filed a lawsuit against Sony Music, a division of Sony BMG. The lawsuit alleges that Sony Music is cheating them (and other bands) out of money; this comes in light of the fact that while Sony Music is selling songs through internet download outlets, they are counting these sales as “physical phonorecords,” which allows them to deduct money that should be paid to the band. Some of the deductions that Sony is able to claim as a result of the download sales being classified as “physical phonorecords,” are for packaging and “breakage,” even though packaging and breakage are clearly not factors in downloadable songs. The bands state that the sale of music downloads equates more to licensing than distribution, and if that’s the case (as it should be) then the bands should be receiving more money. Allegedly, the bands should receive $0.30 out of the $0.70 that Sony currently receives when a downloadable song is purchased. Currently the bands state that they receive significantly less – something to the tune of a nickel. | ||||||||||||
